EPA Increases Penalties by 7.745% in 2023

January 16, 2023.  The Environmental Protection Agency increases penalties by 7.745%.


Effective January 6, 2023, the Environmental Protection Agency (EPA) penalties have increased.  With the recent increases, the penalties are:

  • Clean Air Act - $55,808 to $117,468 Daily, and $446,456 Maximum Per Violation
  • Clean Water Act - $25,847 to $64,618 Daily, and $323,081 Maximum Per Violation
  • RCRA - $70,752 to $117,468
  • CERCLA (including EPCRA) - $67,544, and $202,653 Maximum Per Violation

The increase in penalties represents a 7.745% increase from the maximum penalties in 2022.
