EPA Enhances Penalties for 2024

January 22, 2024.  The Environmental Protection Agency has enhanced its penalties for 2024.


Effective January 6, 2024, the Environmental Protection Agency (EPA) penalties have increased.  With the recent increases, the penalties are:

  • Clean Air Act - $57,617 to $121,275 Daily, and $460,926 Maximum Per Violation
  • Clean Water Act - $26,685 to $66,712 Daily, and $333,552 Maximum Per Violation
  • RCRA - $73,045 to $121,275
  • CERCLA (including EPCRA) - $69,733, and $209,202 Maximum Per Violation

The increase in penalties represents a 3.21% increase from the maximum penalties in 2023.

"EPA violations can be devastating to your reputation and your checkbook," said Adam Crowell, Vice President of Legal and Corporate Development at KPA.  "The clean-ups are expensive and the EPA can force business operations to be suspended," continued Crowell.  "This is one of the many reasons why it is imperative to have a proactive environmental, health, and safety program to identify and resolves issues before they become much bigger issues," concluded Crowell.
